Article 3 – Applicability

These general terms and conditions apply to every offer made by the seller and to every distance contract concluded between the seller and the customer. Before the contract is finalized, the text of these terms will be made available to the customer electronically in a way that allows for easy storage.

Article 4 – The Offer

If an offer has a limited validity period or is subject to specific conditions, this will be explicitly stated. We aim to provide highly accurate descriptions and images of our products. However, the seller is not liable for obvious errors or misprints in the offer. Prices shown include all applicable taxes (VAT) but may exclude delivery charges, which are clearly displayed before checkout.

Article 5 – The Contract

The contract is finalized once the customer accepts the offer and fulfills the specified conditions. We will immediately confirm receipt of acceptance electronically. You may cancel the contract until this acceptance is confirmed. We utilize SSL encryption and appropriate technical measures to ensure a secure web environment for data transmission and payments.

Article 6 – Right of Withdrawal (Returns)

The customer has the right to withdraw from the contract within 14 days without giving any reason. The period begins from the day you, or a third party designated by you, receive the goods.

  • Procedure: To exercise this right, you must notify us via our Contact Page or email using the address provided during your order.
  • Handling: During the cooling-off period, you must handle the product and packaging with care. You should only unpack the product to the extent necessary to decide if you wish to keep it.
  • Return Condition: Products must be returned in their original condition and packaging. Returned items with unpaid shipping costs will not be accepted.
  • Address for Returns: Kenrich House Elizabeth Way, Harlow CM19 5TL, United Kingdom (unless otherwise instructed).

Article 7 – Costs & Refunds

If you exercise your right of withdrawal, return shipping costs are generally borne by the Seller. Refunds will be processed within 3 to 5 business days upon receiving and inspecting the returned goods. We use the same payment method used for the original transaction.

Note: A restocking fee of up to 10% may apply if the product is not returned in its original condition.

Article 8 – Exclusions from Withdrawal

The right of withdrawal does not apply to:

  • Clearly personalized or custom-made goods.
  • Goods liable to deteriorate or expire rapidly.
  • Sealed goods that are not suitable for return due to health protection or hygiene reasons if unsealed after delivery.
  • Business-to-Business (B2B) purchases.

Article 9 – Pricing

Prices will not be increased during the validity period of an offer, except for changes resulting from VAT rate adjustments or legal regulations. Prices listed on the website include VAT.

Article 10 – Conformity and Warranty

The seller guarantees that the products meet the contract specifications and legal requirements. We offer a standard warranty as detailed in our specific product pages. This does not affect your statutory legal rights.

Article 11 – Delivery and Performance

Orders will be processed and delivered to the address provided by the customer. We aim to fulfill orders within 30 days. If a delay occurs, we will notify you. In case of non-delivery, you have the right to a full refund. Risk of damage or loss remains with the seller until the point of delivery to the customer.

Article 12 – Payment

Payment is generally due at the time of purchase via Credit/Debit card, PayPal, or other integrated Shopify Pay methods. If a bank transfer is agreed upon, it must be completed within 14 days of the order date.

Article 13 – Complaints and Disputes

The seller aims to resolve any complaints within 14 days of receipt. If we are unable to resolve a dispute amicably, UK consumers may seek assistance through an Alternative Dispute Resolution (ADR) provider.

While the UK is no longer part of the EU ODR platform, you can seek independent advice from Citizens Advice or submit your dispute to The Retail Ombudsman (https://www.theretailombudsman.org.uk/).

Article 14 – Governing Law

These terms and conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
